Probate Court Fees:
Probate fees are established by statute and are uniform throughout the state.
|Decedent’s Estates Fees|
The probate fee for decedents’ estates is based on the greater of: 1) the gross taxable estate for succession tax purposes (C.G.S. section 12-349), OR the inventory of probate estate OR the Connecticut taxable estate as defined in C.G.S. section 12-391, as amended, OR the gross estate for estate tax purposes (Ch. 217 and 218 of the Connecticut General Statutes), PLUS all damages recovered for injuries resulting in death, LESS hospital and medical expenses and attorney’s fees and costs, LESS 50% of any portion of the property passing to the surviving spouse.
Interest at the rate of 0.5% per month accrues on all unpaid fees on decedents’ estates beginning 30 days after the court issues an invoice, or, if a Connecticut estate tax return has not been filed within the time required, beginning 30 days after the return was due.
The following fees apply to estates of decedents dying on or after January 1, 2015. For decedents dying before January 1, 2015, the fees are set forth in C.G.S. section 45a-107.
